Resolution: Landlords required to provide information about tenants
WHEREAS: Some SMVE HOA homeowners have elected to rent their property, creating a landlord-tenant relationship. For the benefit of all residents, it is critical that landlords provide SMVE HOA with essential tenant information.
WHEREAS: SMVE HOA occasionally needs to contact all residents quickly, including tenants, to advise them of issues of immediate interest, such as safety, fire, crime, and construction or road issues that may impede access. SMVE HOA has contact information for homeowners but not for tenants.
WHEREAS: All SMVE HOA residents are invited to participate in some SMVE HOA activities, but SMVE HOA currently has no way to contact tenants.
WHEREAS: Arizona Revised Statutes 33-1806.01 permits homeowner associations to require a landlord or property manager to supply “the name and contact information for any adults occupying the property, the time period of the lease, including the beginning and ending dates of the tenancy….”
RESOLVED: For all rentals expected to be three months or more, homeowners or their property manager must supply tenant names, address, phone numbers, email addresses and time period of the lease within fifteen days of occupancy. A $15/day penalty will be applied for late or incomplete information.
For homeowners renting on a vacation or seasonal basis, homeowner should advise SMVE HOA what months of the year they are renting and whether they are resident at other times.
Homeowners using a property manager are encouraged to provide name, address, and contact information for the property manager.
Homeowners are reminded that the homeowner is responsible for compliance with SMVE HOA rules and regulations. Any fines or penalties for non-compliance will be assessed against the homeowner, not the tenant. Homeowners should advise their tenants of SMVE regulations (which may be found on the smve.org website). Homeowners are reminded that the CC&Rs specify that rental duration must be 1 month or longer.

This resolution to be effective November 1, 2015. To allow time for notification of homeowners, no penalties will be applied before December 1, 2015.
