Whereas Article XIII, Section 7 of the Sunrise Mountain View Estates C,C,&R’s, which was written by the original Fairfield attorneys, is partly ambiguous and incomplete, causing confusion among many residents of SMVE, and

Whereas residents over the years have asked to have the parking rules clarified to permit cars during the day (not overnight) be able to be parked on the street for up to eight hours to accommodate caregivers, social gatherings, bridge parties, etc. and

Whereas Article XIII, Section 7 of the CC&Rs already states that “Additional designated parking spots, if any, may be designated from time to time by the Board of Directors of the Association”.

Therefore be it resolved that the SMVEHOA Board enact the following clarifications and additions to parking on the private streets in SMVE by residents and their guests:

While SMVE residents should park their automobiles in the garage, on their driveways, and/or in designated parking areas closest to their homes whenever possible, and their guests should park their automobiles either in the driveways or nearest designated parking areas if possible.

If the garage and driveway are occupied or unavailable, and the designated parking areas are occupied or too far away to be practical, those residents and their guests may park on the street adjacent to the property in a manner not to block the street or sidewalk and not to block access to ANY driveway.

  1. No resident, tenant, or guest is permitted to park on the street for more than eight hours during any 24 hour period.
    The prohibition against ANY “overnight parking” remains in effect for safety reasons.
  2. As homeowners are responsible for the actions of their guests, and/or tenants and have the responsibility to inform their guests of our rules concerning them when they are in the subdivision, the homeowners shall be responsible for any penalties incurred by violations of these (and all other) provisions in the CC&R’s, and Rules and Regulations promulgated by the Board.

The Board passed another motion to alter the Offenses and Penalties in the Rules and Regulations to raise the penalties for violations of vehicle parking in the SMVE subdivision. The new penalties are:

Twenty ($20) Dollars for the first occurrence after the receipt of a warning letter and Fifty ($50) Dollars per occurrence within one year of the previous occurrence.
